Agreement and Disclaimer

Welcome to Soul Paint, where we hope you will enjoy being taken on a journey to explore and creatively express feelings and sensations in your body. We present this agreement at all showings of the experience, and for full transparency make this available for anyone who would like to read these before/after the experience.

Before you participate in this experience, there are a few things we feel important to highlight, such as our health and safety guidelines. Also included is information on how we would like to use the content you produce during the experience, with your consent.  

By agreeing to participate in the Soul Paint experience, you confirm that you are aged 13 or older. If you are under 18, you must have your parent or legal guardians’ consent to participate.

Health and Safety

Please read and follow this health and safety notice before participating in the Soul Paint experience.

You must follow all health and safety instructions from us at all times. If you do not, we reserve the right to immediately suspend any admission to the experience.

Please be aware of your surroundings when using the virtual reality equipment.

You understand that Soul Paint is an experience within an immersive environment using virtual reality headsets and moving motion platforms. Most people do not suffer from any side effects, however we need to make you aware that some can experience certain side effects such as:

  • motion sickness

  • epileptic seizures

  • loss of awareness

  • dizziness

  • nausea

  • momentary loss of consciousness

  • Please consult a doctor or healthcare professional before taking part in the experience if you are pregnant, elderly or have any pre-existing medical or health conditions.

Please immediately stop taking part in the experience and using the virtual reality equipment if you feel any discomfort whatsoever.

Your Participation

Within the Soul Paint experience, you will be able to map your movements (Movements), create 3D drawings and illustrations which are paired to your Movements (Illustrations), and create audio/voice recordings (Voice Recordings) (together, Content).

We would love to be able to use your Content to improve our experience, use for promotional purposes, and include in our archive for other people to see and hear. In some cases we shall request your separate consent.

Illustrations and Movements: By entering into this agreement you agree that, in consideration of us providing you with the Soul Paint experience:

  • any Illustrations and Movements will automatically belong to us on creation and you hereby assign to us any intellectual property rise that may arise in these; and

  • we can use any of the Illustrations and Movements in any advertising, promotional and marketing material in relation to Soul Paint. 

Voice Recordings: You will be able to confirm whether or not you agree to share your Voice Recordings with us - this will be asked at the end of the experience. If you do agree to share the Voice Recordings with us, you, in consideration of us providing you with the Soul Paint experience, grant to us a non-exclusive, royalty-free licence to use the Voice Recordings in any advertising, promotion and marketing material in relation to Soul Paint.

We confirm that we will not share your Illustrations, Movements or Voice Recordings with any third parties unless we obtain your consent first.

Please note that you can request for us to remove your Illustrations, Movements and Voice Recordings from our system, by speaking to a member of staff or contacting us at the email address below.

Privacy

We take the privacy of your personal information seriously and will ensure that any personal information we hold about you will be protected and stored and processed securely, with appropriate safeguards and in accordance with applicable data protection laws.

Generally you provide most of the personal information to us directly, which may include your name, email address and voice data to participate in the Soul Paint experience. Our legal basis for doing so is that it is in our legitimate business interests to obtain this information so that we can provide our services to you, as well as to update and improve our services.

We process information about you, if any, in accordance with our privacy policy, which is found on soulpaint.co. You warrant that all data provided by you is accurate.

General Information

You acknowledge that the Soul Paint experience (and any technology and software contained within it) is provided ‘as is’. That means we don’t make any promises to you about the experience, other than it will be of satisfactory quality, as described and fit for purpose.

We may end your rights to participate in the Soul Paint experience at any time if you breach this agreement or any of our reasonable instructions from time to time.

We may change or update these terms from time to time, but changes only affect you to the extent they can legally apply.

We may assign our rights and obligations under these terms without your consent. You may not assign or transfer your rights or obligations unless we expressly agree to it in writing.

We will not be liable or responsible for any failure or delay to perform any of our obligations under these terms that is caused by an event that is outside of our control, including without limitation internet outages, fire, flood, war or acts of God.

We do not accept liability for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with (i) use of, or inability to use, the experience, or (ii) use of or reliance on any content included in the experience.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so (including the death or personal injury caused by our negligence).

Other than as mentioned above, our overall liability to you is limited to the face-value price for the ticket you paid to access the experience or, where no price was paid, £10.

Nothing in these terms is intended to limit any rights you might have as a consumer.

Nothing in these terms is intended to confer any benefit of any person who is not a party to it.

If any part of these terms are found to be unenforceable, the terms will be amended to the minimum extent necessary to make such part enforceable and the remainder of the provisions will remain in full force and effect.

These terms shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts, save that you may have the legal right to bring proceedings in your local jurisdiction.
